Washington Attorney General Rob McKenna continues to fight for the survival of the Yucca Mountain nuclear waste project.
Today, his office argued its case in front of the U.S. Court of Appeals for the District of Columbia Circuit in Washington DC.
The Department of Energy has requested that the massive project be terminated, but McKenna's senior counsel says the DOE does not have the authority to pull the plug, only congress can do that.
McKenna says Washington hosts and oversees nearly two-thirds of the nation's defense related radioactive waste.
Yucca Mountain would provide a permanent home for those hazardous materials.
The court of appeals does not have a timeline to make a decision.
McKenna's office is hoping for an expedited ruling.
